Welcome to Aussie Blooms (aussieblooms.au). These Terms and Conditions ("Terms") govern your access to and use of our website (the "Site") and your purchase of any products or services ("Products") offered by Aussie Blooms ("we," "us," "our"). By accessing our Site or purchasing Products from us, you agree to be bound by these Terms. Please read them carefully.

Aussie Blooms may amend these Terms from time to time, and any amendment will become effective immediately upon posting on this Site. Your continued use of this Site after any amendment constitutes your agreement to abide by and be bound by these Terms, as amended.

1. Disclaimer

The information and Products on this Site are provided on an "as is" and "as available" basis. While we strive for accuracy, Aussie Blooms makes no express or implied warranties regarding the operation of the Site or the information, content, materials, or Products included on this Site.

2. Product Images & Availability

Images on aussieblooms.au are for display purposes to represent the style and general appearance of our Products. As flowers are natural items, variations in exact shade, size, and stem count may occur. Actual Products delivered may differ slightly while always maintaining the overall value, aesthetic, and sentiment of the item ordered. Our florists handcraft each arrangement, so no two are identical.

3. Substitution Policy

We strive to ensure all advertised Products are available. However, due to seasonal variations, market availability, and order volumes, specific components may occasionally be unavailable.

  • Notification & Authorization: For significant component unavailability, we will endeavor to contact you to discuss alternatives or authorize a substitution. For timely delivery, especially for same-day/next-day orders, immediate contact may not always be feasible.
  • Substitution with Care: If direct contact is not feasible or for minor substitutions, Aussie Blooms will substitute with items of equal or greater value, maintaining the overall style, colour, and aesthetic of the requested item.
  • Rules:
    • Overall Aesthetic: We aim to achieve the same overall shape, style, and effect.
    • Assorted Arrangements: The primary colour scheme and style will be maintained, possibly by substituting flower types of equal or greater value.
    • Specific Flower/Plant Types (e.g., all Roses): We will prioritize matching the flower/plant type. If the exact colour is unavailable, we may substitute with another suitable colour of the same type and value.
    • Gift Hampers & Add-ons: Unavailable non-floral items will be substituted with a similar item of equal or greater value.

4. Delivery Policy

Detailed delivery information, including specific fees, cut-off times, and procedures, can be found on our Delivery Information page and our Shipping Policy.

  • Fees: Standard Next Day Delivery is $19.95. Same Day Delivery (where available) incurs a $5.00 surcharge (total $24.95). A redelivery fee of $19.95 may apply for incorrect addresses or recipient unavailability.
  • Cut-Off Times: Generally, 4:00 pm local time for Next Day Delivery (day prior) and 1:00 pm local time for Same Day Delivery. These may vary during peak periods.
  • Delivery Days & Times: Typically Monday to Saturday, 8 am – 5 pm (up to 9 pm residential). No standard Sunday or national public holiday deliveries (exceptions for Valentine's/Mother's Day may apply). Specific times cannot be guaranteed.
  • Recipient Unavailability: If the recipient is not home, items may be left in a secure location if instructed/deemed safe, or a redelivery (fee may apply) will be arranged. Aussie Blooms is not liable for items after safe delivery/ATL.
  • Incorrect Address: A redelivery fee ($19.95) and potentially costs for new perishable Products will apply if an incorrect address is provided.

5. Alcohol Policy

(Currently not applicable) You must be 18 years or older to purchase any alcoholic products from us. If you are purchasing an alcoholic product, you warrant to Aussie Blooms that you are 18 years or older and that the recipient of the product is 18 years or older. Aussie Blooms will not be liable if any underage person purchases or receives an alcoholic product. You indemnify Aussie Blooms for any loss or damage suffered by Aussie Blooms for a breach by you of this warranty. All alcohol sales are subject to Australian Federal, State, and Territory liquor licensing laws.

6. Order and Cancellation Policy

  • Business Hours: Customer service operates 8 am to 4 pm AEST/AEDT, Monday to Friday.
  • Order Changes: Please verify all details before submission. Request changes via [email protected] within 1 hour of ordering. A $10 administration fee may apply for later changes, if possible.
  • Cancellations:
    • Within 1 hour of ordering: Generally no charge if not yet processed.
    • More than 1 hour after ordering but 36+ hours before delivery: $25 fee may apply (if not prepared).
    • Less than 36 hours before delivery, or if prepared/dispatched: Fee up to full order value may apply.
    • Orders already prepared or dispatched generally cannot be cancelled.
    • Sales during peak holidays (Valentine’s Day, Mother’s Day, Christmas) are generally final.

7. Promotion & Discount Policy

  • Promotions generally cannot be combined.
  • Typically apply to Next Day Delivery unless stated otherwise.
  • Must be applied at time of purchase.
  • Aussie Blooms reserves the right to modify or end promotions at its discretion.
  • Discounts/coupons have no cash value.
  • Discounts usually exclude taxes/delivery (except for "Free Delivery" promotions).
  • E&OE. Specific promotions may have additional terms.

8. Corporate Orders - Invoicing

For Corporate Partners with agreed monthly invoicing, payment is due upon invoice receipt or per agreed terms. Non-payment or abuse of discounts may lead to account termination, with outstanding balances remaining due.

9. Intellectual Property

All content on this Site (text, graphics, logos, images, software) is the property of Aussie Blooms or its content suppliers and is protected by copyright laws.

10. Limitation of Liability

To the full extent permissible by law, Aussie Blooms disclaims all warranties. Aussie Blooms will not be liable for damages arising from Site use or Product purchase, except for liability non-excludable under Australian Consumer Law. Our liability for any breach of an implied condition or warranty is limited, at our option, to: (a) resupplying the Products; or (b) paying the cost of resupplying the Products.

11. Governing Law
